Release of investigation into Weld County commissioner awaits judge’s ruling

The Greeley Tribune: Weld County Commissioner Sean Conway’s attorney at a Weld District Court hearing Wednesday said the commissioner supported the release of a 17-page investigative report regarding allegations of harassment against the commissioner, but attorney Jill Gookin argued against the release of 149 pages of attachments to the report.

Gookin appeared alongside Weld County attorney Bruce Barker, who petitioned the court for a determination on whether the report should be made public following a Greeley Tribune open records request.

Judge Todd Taylor is expected to rule soon.

The report, prepared by Mountain States Employers Council, contains details of accusations made by six women against Conway in the past few years.

Conway is accused of yelling and cursing at one employee Nov. 28, and the county’s petition to the court indicated five other women had similar complaints. County officials say they can’t determine whether the report is public, and therefore petitioned the court for a ruling.

The key issue in this case is whether the harassment complaints against Conway fit into the definition of hostile work environment, and therefore, fit broadly under sexual harassment.

Colorado law prohibits the release of investigative records related to sexual harassment. Court cases have held a “hostile work environment” created by harassment qualified as sexual harassment.
