Lake County appeals open-access ruling that favored Herald Democrat newspaper

From the Herald Democrat (Leadville):  The Herald Democrat learned Monday that the Lake County Board of Commissioners has filed an appeal in the Herald’s lawsuit against the BOCC related to the Colorado Open Records Act and Open Meetings Law.

This case was heard in district court on March 6, and Judge Wayne Patton ruled on March 25 in favor of the Herald.

The BOCC was ordered to release recordings made of two meetings held on Feb. 19 and 20, but the judge stayed that portion of his order for 49 days (until May 13) in case the BOCC decided to appeal. The BOCC is also asking the court to stay execution on the order to release the recordings until its appeal can be heard.

Attorneys for the BOCC indicate that the appeal consists of whether the district court erred in three instances: in concluding that the BOCC violated the Colorado Open Meetings Law, in granting the Herald’s application for a show cause order and directing the BOCC to disclose the records, and in finding that the Herald was entitled to an award of attorneys’ fees and costs.
