The Denver Gazette: The Colorado Court of Appeals denied two petitions for rehearing last week in a case involving the Douglas County Board of County Commissioners’ violations of open meetings laws.
On April 16, both the plaintiffs — Robert C. Marshall, Lora Thomas and Julie Gooden — and the defendants, the Douglas County Board of County Commissioners, asked the court of appeals to rehear the case.
The BOCC requested a rehearing on the grounds that the appeals court made “factual and legal conclusions” in finding the commissioners violated open meetings laws, conclusions the board said extended beyond the court’s authority.
“Accordingly, Douglas County respectfully requests this Court modify the Opinion to reflect the correct procedural posture and to allow for the fulsome fact-finding proceedings that remain in this case,” the petition states.
