Special prosecutor declines to file charges in Loveland City Council open meetings case

Loveland Reporter-Herald: Four current and three former members of Loveland City Council will not be criminally prosecuted for alleged violations of state and municipal open meeting laws.

Late Sunday, special prosecutor Kathy Haddock sent notice to acting Loveland City Attorney Vince Junglas that she is declining to pursue the case further.

“After reviewing the report and applicable case law, I do not believe that the report includes evidence, or the likelihood that evidence exists, to prove that a violation of the OML (Colorado open meeting law), or the city charter or code has occurred by the April 19 and 27, 2023 letters,” Haddock’s statement reads in part. “Therefore, there is not probable cause for me to file any criminal charge. There are occurrences described in the report that the city may want to adopt policies or an ordinance to prevent from happening in the future, but the existing laws have not been violated.”
