El Paso County sheriff denies Post’s request for video apology

From The Denver Post:  The El Paso County Sheriff’s Office has denied a Denver Post request for a copy of Sheriff Terry Maketa’s videotaped apology to employees.

The videotape did not meet the definition of public record, Charles C. Greenlee , legal advisor for the sheriff’s office, wrote in a letter denying the request.

“The mere fact that the video resides on a County server or was made by a public official using publicly-funded resources does not make it a public record,” Greenlee wrote.

The video was a correspondence between the sheriff and his staff and had nothing to do with the function of the sheriff’s office, he said.

The Post requested the video Monday through the Colorado Open Records Act after a sheriff’s department employee recorded the video with a cell phone and leaked it to the Colorado Springs Gazette.
