Attorney claims City of Florence violated Open Meetings Law during June 10 special meeting

Cañon City Daily Record: Colorado attorney Matt Roane has brought another lawsuit against the City of Florence, positing that the city council violated Colorado’s Open Meetings Law during a June 10 special meeting.

The lawsuit filed June 19 states, “Colorado’s Open Meetings Law (COML) declares it to be a matter of statewide concern and the policy of this state that the formation of public policy is public business, and it may not be conducted in secret,” though, in limited circumstances, the state authorizes local public bodies to conduct private executive sessions, which are closed to the public.

To legally hold an executive session, a local public body must satisfy several requirements, notes the lawsuit, including the announcement, “to the public of a particular matter intends to discuss in the executive session as as much detail as possible without compromising the purpose for which the executive session is authorized,” and, “A local public body must restrict its executive session discussion to one of the permissable subject matters set forth.”
