Records request for gag order denied in Fremont County shooting

Daily Record (Canon City): A formal records request for a gag order issued by the Fremont County Courts regarding a shooting last week has been denied.

On Monday, the Daily Record filed a formal Colorado Open Records Act request with the Fremont County Clerk’s Office, requesting the gag order, which was issued last Thursday.

The gag, or hush, order was ordered by District Judge Lynette Wenner, prohibiting any additional information about the shooting from being released.

According to an initial news release from CCPD, a man was taken by Flight for Life in the early morning of June 28 after he was shot.

At about 1 a.m., officers from the Cañon City Police Department were dispatched to St. Thomas More Hospital after it was reported a man was there with a gunshot wound.

The 46-year-old man, who is unidentified at this time, was taken to Penrose Hospital in Colorado Springs.

Details, including the seriousness of the man’s injuries, how the man sustained the gunshot wound or where he was shot, are still unknown as they have not been released, and the gag order now prohibits all officials in the matter to be silent on the subject.

District Attorney Molly Chilson on Friday explained that there are times in cases when court orders are put in place, such as when documents are sealed or when media is limited in a hearing, to protect the privacy of the case.

She said this could be for a number of reasons, such as protecting the investigation or witnesses.
