Larimer clerk orders college newspaper removed because of Udall photo

From The Denver Post:  A county clerk forced Colorado State University’s Collegian newspaper to remove editions bearing a front-page picture of Sen. Mark Udall from a campus area near a ballot drop-off, saying the photo amounted to electioneering.

The photo showed Udall, a Democrat in a tight race for his seat with Republican U.S. Rep. Cory Gardner, at the campus during his visitthere on Monday.

“Obviously, I disagree because we are covering news, not promoting candidates,” Kate Winkle, the Rocky Mountain Collegian editor, said Tuesday.

Larimer County Clerk and Recorder Angela Myers threatened to confiscate the newspapers if they weren’t removed from racks at the Lory Student Center on Tuesday morning, Steve Zansberg, a lawyer for the newspaper, said in a letter to Myers. He noted that she cited a state statute that bars electioneering within a 100-foot limit of any polling location.

Newspapers in racks containing The Denver Post, USA Today and the New York Times are also within the 100-foot limit but were not removed.

Zansberg said Myers’ interpretation of the statute is wrong and unconstitutional.
