Board to discuss complaint regarding Aurora theater shooter’s whereabouts

From The Denver Post: A state board will meet Friday to decide whether the Colorado Department of Corrections is violating victims’ rights by refusing to reveal where the Aurora movie theater killer is locked up.

Several victims of the attack filed a complaint against the DOC this year. Members of the Victims Rights Act Subcommittee of the Crime Victim Services Advisory Board are scheduled to discuss the complaint at a meeting Friday afternoon in Lakewood.

Prison officials shipped killer James Holmes out of state in January after he was attacked at a maximum-security prison in Cañon City. The officials said the transfer was done in the interest of safety, both for Holmes and for correctional officers. He is now probably being held under a pseudonym, and the DOC won’t tell victims or even the district attorney’s office that prosecuted the case where he is.

The specific details of the victims’ complaint are private until after Friday’s hearing, and no victims who filed the complaint responded to a request for comment that was relayed through the 18th Judicial District Attorney’s office. A DOC spokeswoman has defended the secrecy as necessary for security.

There will be no testimony from the victims, prison officials or the public at Friday’s meeting, said Patricia Billinger, a spokeswoman for the Colorado Department of Public Safety. Instead, the seven members of the subcommittee will review the state’s Victim Rights Act and discuss whether there is a “basis in fact” that the DOC is breaking the law by not disclosing the inmate’s location.
